Your Big Rig Accident Attorney Explains What Laws Govern Truckers.

Ohio Truck Accident Injury Lawyer - Cleveland Big Rig Injury Attorneys – Call The Right Attorney - Cleveland, Ohio

After a truck accident, your big rig accident attorney will look to many regulations, both state and federal, that trucking companies are required to follow. These laws include the following:

1. Trucking companies are required to follow the Federal Motor Carrier Safety Administration’s regulations concerning equipment and hours of service.

2. Title 49, Code of Federal Regulations allows Interstate truck drivers to drive 11 hours in a work period, but prohibits driving after 14 hours since coming on-duty, and requires at least 10 consecutive hours off-duty to re-qualify for a new work period.

3. Truck drivers are required to maintain a driver’s log regarding miles, travel times and rest stops.

4. Truck drivers cannot report for duty with a blood alcohol concentration of 0.02 or greater; cannot possess alcohol, including medications like cough syrup or cold medicine that contain alcohol, unless it is part of a shipment; cannot consume alcohol while performing safety-sensitive functions; consume alcohol within eight hours of driving; cannot report for duty while using any drug that affects the driver’s ability to safely operate a motor vehicle; and must submit to any Department of Transportation mandated alcohol or drug test.

5. Federal regulations require commercial trucks to carry certain levels of insurance coverage, depending on the nature of the materials hauled. These regulations protect victims of large truck crashes from truck owners who may not have the financial resources to pay damages out-of-pocket.

6. Commercial driver’s license standards are federal regulations in place to reduce or prevent truck accidents and resulting injuries and/or deaths by requiring drivers of certain vehicles to obtain a single commercial motor vehicle driver’s license.
